1. The applicant Joseph Owino Omollo was the appellant in HCRA 55/2017 which was determined by this court and dismissed on October 7, 2019. He filed Notice of Appeal on October 15, 2019 and the records held by this court show that the Registry submitted the original court file and records of appeal to the Court of Appeal at Kisumu hence there is no leave that can be granted by this court to appeal out of time.

2. The convict/applicant should flow up his appeal at the Court of Appeal.

3. This application is devoid of any merit.
