Ruling

1. I have considered the submissions of both sides. The applicant has exhibited the mediation agreement signed by the parties. At the same time, the respondent has confirmed that a case against the applicant has already been filed at the Kibera law courts.

2. In the circumstances, this court is persuaded that it would be proper to place the applicant on bail pending his appearance before the lower court. I accordingly order that the applicant be placed on a personal bond of ksh 200,000/=. The Respondent’s are restrained in the meantime restrained from arresting the applicant or placing him in any cells or custody over this issue. This bond shall automatically lapse on November 14, 2022, the date the applicant is to present himself before the trial court. This file is ordered closed. It is so ordered.
