Ruling

1. This file was opened for purposes of considering whether the convict Stephen Omondi Otieno is suitable for consideration of his sentence review in the spirit of prison decongestion pursuant to the Chief Justice Memo dated 7th December 2022.

2. The applicant was convicted of the offense of housebreaking contrary to Section 304(1)(a) of the Penal Code. Upon conviction, he was sentenced to pay a fine of Kshs. 100,000, with an alternative sentence of 12 months' imprisonment in case of default. The court ordered that the sentence commence from the date of his arrest, which was 3rd November 2023.

3. As a result, the applicant has now fully served the sentence and has completed his term of imprisonment.Orders accordingly.
