Dissatisfied with the judgment, the\hich\af0\dbch\af12\loch\f0 appellants appealed to this court on five (5) grounds of appeal, namely:- \par {\listtext\pard\plain\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 1.\tab}}\pard \qj \fi-705\li1425\ri0\sl360\slmult1\widctlpar\jclisttab\tx1425\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin1425\itap0\pararsid2045008 { \dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 The decision of the learned trial magistrate is not supported by evidence on record. \par {\listtext\pard\plain\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 2.\tab}\hich\af0\dbch\af12\loch\f0 The learned trial magistrate failed to properly appraise and evaluate the evidence on record and\hich\af0\dbch\af12\loch\f0 thereby came to a wrong decision. \par {\listtext\pard\plain\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 3.\tab}\hich\af0\dbch\af12\loch\f0 The learned trial magistrate erred in law and fact in failing to visit the locus in quo to ascertain on the ground the actual suit land. \par {\listtext\pard\plain\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 4.\tab}\hich\af0\dbch\af12\loch\f0 The decision of the learned trial magistrate has occasioned a total miscarriage of j\hich\af0\dbch\af12\loch\f0 ustice to the appellants. \par {\listtext\pard\plain\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 5.\tab}\hich\af0\dbch\af12\loch\f0 There are fundamental errors patent on the face of the record. \par }\pard \qj \fi720\li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2045008 {\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 The appellants prayed this court to allow the appeal by setting aside the decision of the lower court, }{\dbch\af12\insrsid2715876\charrsid2045008 \hich\af0\dbch\af12\loch\f0 and for }{\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 judgment}{\dbch\af12\insrsid2715876\charrsid2045008 \hich\af0\dbch\af12\loch\f0 to}{\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 be entered for the appellants with cos\hich\af0\dbch\af12\loch\f0 ts.
\par \hich\af0\dbch\af12\loch\f0 The respondent opposes the appeal and prays this court not to disturb the judgment and orders made by the lower trial court. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2045008 {\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 In the appeal, learned }{\dbch\af12\insrsid4747307\charrsid2045008 \hich\af0\dbch\af12\loch\f0 Counsel}{\dbch\af12\insrsid6697601\charrsid2045008 \hich\af0\dbch\af12\loch\f0 R. I. S. Oyoit represented the appellants while learned counsel Twontoo Obaa represente\hich\af0\dbch\af12\loch\f0 d the respondent. Both respective counsel filed written submissions. \par \tab \tab \hich\af0\dbch\af12\loch\f0 Grounds 1 and 2 were considered together. \par }{\dbch\af12\insrsid1186967\charrsid2045008 \tab \tab \hich\af0\dbch\af12\loch\f0 For the appellants, it is submitted that the judgment of the trial magistrate was very short, superficial and vague and did not consider in\hich\af0\dbch\af12\loch\f0 depth the evidence adduced before him as a whole and thereby hurriedly}{\dbch\af12\insrsid15085308\charrsid2045008 \hich\af0\dbch\af12\loch\f0 believed the respondent\hich\f0 \rquote \loch\f0 s case. This led the trial magistrate to reach wrong conclusions in the case.}{\dbch\af12\insrsid1186967\charrsid2045008 \par }{\dbch\af12\insrsid15085308\charrsid2045008 \tab \tab \hich\af0\dbch\af12\loch\f0 On the other hand, it is submitted for the respondent, that a judgment need not\hich\af0\dbch\af12\loch\f0 be in many pages or long to be proper}{ \dbch\af12\insrsid2715876\charrsid2045008 \hich\af0\dbch\af12\loch\f0 .}{\dbch\af12\insrsid15085308\charrsid2045008 \hich\af0\dbch\af12\loch\f0 The trial magistrate properly directed his mind on the facts and the law on all the available evidence in reaching his conclusion. There is therefore, according to the respondent, no merit in grounds 1 and 2 of the \hich\af0\dbch\af12\loch\f0 appeal.

All that the court record shows is that, each one of them, proceeded to testify, soo\hich\af0\dbch\af12\loch\f0 n after particulars}{ \dbch\af12\insrsid4934066\charrsid2045008 \hich\af0\dbch\af12\loch\f0 of their names and residences had been taken.}{\dbch\af12\insrsid16218852\charrsid2045008 \par }{\dbch\af12\insrsid4934066\charrsid2045008 \tab \tab \hich\af0\dbch\af12\loch\f0 The failure to ensure that evidence is given on oath and for the court record to clear}{\dbch\af12\insrsid2715876\charrsid2045008 \hich\af0\dbch\af12\loch\f0 ly}{ \dbch\af12\insrsid4934066\charrsid2045008 \hich\af0\dbch\af12\loch\f0 so state in respect of all parties and their witnesses, except for the second appellant, makes the \hich\af0\dbch\af12\loch\f0 trial in the lower court a nullity as the evidence so adduced is deprived of any validity and value as proper evidence. \par }{\dbch\af12\insrsid2951406\charrsid2045008 \tab \tab \hich\af0\dbch\af12\loch\f0 Grounds 1 and 2 of the appeal therefore succeed in sense that there was no valid evidence before the trial court for that court to eva\hich\af0\dbch\af12\loch\f0 luate so as to be able to reach the conclusions it reached. \par \tab \tab \hich\af0\dbch\af12\loch\f0 Ground 3 faults the trial court for failing to visit the locus in quo. \par \tab \tab \hich\af0\dbch\af12\loch\f0 There is merit in this ground. The dispute concerning the suit land is whether or not the }{\dbch\af12\insrsid13773150\charrsid2045008 \hich\af0\dbch\af12\loch\f0 disputants have gone over th \hich\af0\dbch\af12\loch\f0 e borders of their respective portions of land and trespassed onto that of their opponent(s). on page 11 of the }{\dbch\af12\insrsid4747307\charrsid2045008 \hich\af0\dbch\af12\loch\f0 typed}{ \dbch\af12\insrsid13773150\charrsid2045008 \hich\af0\dbch\af12\loch\f0 }{\dbch\af12\insrsid4747307\charrsid2045008 \hich\af0\dbch\af12\loch\f0 proceedings}{\dbch\af12\insrsid13773150\charrsid2045008 \hich\af0\dbch\af12\loch\f0 , the court proceedings of 15.04.2004 show that in a }{\b\ul\dbch\af12\insrsid2715876\charrsid2045008 \hich\af0\dbch\af12\loch\f0 Civil A}{\b\ul\dbch\af12\insrsid13773150\charrsid2045008 \hich\af0\dbch\af12\loch\f0 ppeal No. 7 of 1995; Philip}{ \b\ul\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 Onono vs Emmanuel Okello,}{\b\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 }{\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 on 30.04. 97}{\b\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 ,}{\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 the learned chief Magistrate, Godfrey Namundi, who entertained that appeal ordered the trial court Grade II at Aduku, in conjunction with the local leaders to demarcate the proper boundaries of the appellant\hich\f0 \rquote \loch\f0 s land not in dispute.}{\dbch\af12\insrsid2951406\charrsid2045008 \par }{\dbch\af12\insrsid12846965\charrsid2045008 \tab \tab \hich\af0\dbch\af12\loch\f0 It was thus incumbent\hich\af0\dbch\af12\loch\f0 upon the trial court to ascertain, first, whether the suit land in }{\b\ul\dbch\af12\insrsid2715876\charrsid2045008 \hich\af0\dbch\af12\loch\f0 C}{\b\ul\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 ivil }{\b\ul\dbch\af12\insrsid2715876\charrsid2045008 \hich\af0\dbch\af12\loch\f0 A}{\b\ul\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 ppeal No. 7 of 1995,}{\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 was the same suit land in the suit before him, and if so, whether the borders demarcated by court in conjunction with the local leaders, as showing the appellan\hich\af0\dbch\af12\loch\f0 t\hich\f0 \rquote \loch\f0 s land had been violated or not, and if violated, whether it was the appellants who had done the violation. All this could have been best done by the trial court visiting the locus in quo and ascertaining the boundaries of the suit land, the subject of \hich\af0\dbch\af12\loch\f0 \hich\af0\dbch\af12\loch\f0 the dispute. That way the trial court would have been in a position to decide, who of the appellants and respondent, was }{\dbch\af12\insrsid7414504\charrsid2045008 \hich\af0\dbch\af12\loch\f0 committing}{\dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 trespass, on the other\hich\f0 \rquote \loch\f0 s land. This court therefo}{\dbch\af12\insrsid7414504\charrsid2045008 \hich\af0\dbch\af12\loch\f0 r}{ \dbch\af12\insrsid12846965\charrsid2045008 \hich\af0\dbch\af12\loch\f0 e holds that failure by the trial court to visit locus in quo was an err\hich\af0\dbch\af12\loch\f0 or that resulted in a miscarriage of justice. Ground number 3 of the appeal succeeds. \par }{\dbch\af12\insrsid12349317\charrsid2045008 \tab \tab \hich\af0\dbch\af12\loch\f0 As to grounds 4 and 5 of the appeal, this court has already pointed out instances of miscarriage of justice and fundamental errors committed by the trial court, making \hich\af0\dbch\af12\loch\f0 the trial a nullity. Albeit all of them, are not necessarily the instances raised by the appellant\hich\f0 \rquote \loch\f0 s counsel. Grounds 4 and 5 therefore also succeed. \par }{\dbch\af12\insrsid10438800\charrsid2045008 \tab \tab \hich\af0\dbch\af12\loch\f0 In the result this appeal succeeds.
