1. I have perused the court file and it would appear on the face of the record that the plaintiff is a protected tenant under Cap 301 of the Laws of Kenya.

2. This is a dispute/matter that touches on issues of rent payment and repairs/improvement of the suit premises.  This matter therefore falls under the jurisdiction of the Business Premises Tribunal.

3. For these reasons, I therefore transfer this matter to the Business Premises Tribunal.  The Deputy Registrar to facilitate the same.
