1. Having considered the appellant’s notice of motion dated June 17, 2023 supported by the affidavit sworn by the appellant of similar date, I hereby make the following orders:1. That the matter is certified urgent.2. That a stay of execution is hereby granted staying the orders of compensation of a sum of Kshs 10,250,000/= to the complainant in Milimani Chief Magistrate’s Court Criminal Case No 375 of 2018 pending hearing and determination the appeal.3. That the criminal registry is directed to prepare the record of appeal within 60 days from the date hereof.4. That the appellant is directed to file and serve their appeal on or before August 23, 2023. 5.That the respondent is directed to file a response on or before September 7, 2023. 6.That the matter will be mentioned for directions on September 20, 2023Orders accordingly.
