She also sought for an order for costs. \par }{\insrsid14812205\charrsid15278858 The p1antiff\rquote s cas}{\insrsid13007470\charrsid15278858 e}{\insrsid14812205\charrsid15278858 was that the deceased Kaijabohore left a cow land (Ki}{\insrsid13007470\charrsid15278858 ban}{ \insrsid14812205\charrsid15278858 ja) and a house situated at Kito vill}{\insrsid13007470\charrsid15278858 age, Mirambi Parish Kyarusozi Mwenge Kabarole Distr}{\insrsid14812205\charrsid15278858 ict. All }{\insrsid13007470\charrsid15278858 the }{ \insrsid14812205\charrsid15278858 property is valued}{\insrsid13007470\charrsid15278858 }{\insrsid14812205\charrsid15278858 at shillings one million. The deceased Kaijabohore}{\insrsid13007470\charrsid15278858 }{\insrsid14812205\charrsid15278858 produced and left }{\insrsid13007470\charrsid15278858 the plaintiff as his only child, and an aged motherless widow called }{\insrsid14812205\charrsid15278858 Kwebiiha her}{\insrsid13007470\charrsid15278858 }{\insrsid14812205\charrsid15278858 step mother. He is a Mu}{\insrsid13007470\charrsid15278858 se}{\insrsid15402605\charrsid15278858 n}{\insrsid13007470\charrsid15278858 gya by clan whereas the deceased and the plaintiff are Babiito by clan. The defendant was not }{\insrsid15402605\charrsid15278858 given the Kibanja by the decease}{\insrsid13007470\charrsid15278858 d. He has his own land (Kibanja) and house on a separate }{\insrsid15402605\charrsid15278858 village}{\insrsid13007470\charrsid15278858 of Kisenyi village Ky arusozi Mwenge. The defendant never looked after the widow and the deceased and if he gave any assistance the same was not given as a price or consideration for taking away the property of the deceased Kaijabohore at the time of his death. He had boils and wa}{\insrsid13007470\charrsid15278858 s }{ \insrsid15402605\charrsid15278858 mentall}{\insrsid13007470\charrsid15278858 y }{\insrsid15402605\charrsid15278858 unstable. \par }{\insrsid13007470\charrsid15278858 The case for the defendant was that his land (Kiban}{\insrsid15402605\charrsid15278858 ja.\} was adjacent to that of the late Kaijaboho}{\insrsid13007470\charrsid15278858 re the deceased. He is a cattle trader. }{ \insrsid15402605\charrsid15278858 The}{\insrsid13007470\charrsid15278858 deceased used to sell him his animals and sometimes the former used to sell him the animals on credit. The deceased used to graze his animals on his land and used to provide the deceased w}{\insrsid15402605\charrsid15278858 ith some boozes (native drinks),}{\insrsid13007470\charrsid15278858 }{\insrsid15402605\charrsid15278858 so}{\insrsid13007470\charrsid15278858 the two became very friendly. Some time in the 1980\rquote s the deceased and his wife Kwebiiha the widow were attacked by thieves, who stole a number of their personal effects and even beat up the couple seriously. H e together with other people assisted the couple in replacing some of their stolen properties personal effects like clothing plates and extra. At the same time the deceased became weak and developed pneumonia. The couple were weak and elderly. He looked a fter the couple. He gave treatment to the deceased who was sickly and provided them with necess}{\insrsid15402605\charrsid15278858 aries for their lives like food}{\insrsid13007470\charrsid15278858 and even used to get water for them. The plaintiff and the deceased were}{\insrsid15402605\charrsid15278858 arch enemies. The former never}{\insrsid13007470\charrsid15278858 assisted her father at all . Because of the services he rendered the couple, the deceased out of his free will gave him his land and an agreement exhibit Dl dated 23/8/88 was made to }{\insrsid15402605\charrsid15278858 confirm}{\insrsid13007470\charrsid15278858 that. The couple used to rear some cattle. Most of the animals died and there remained only one cow. On one }{\insrsid15402605\charrsid15278858 occasion}{\insrsid13007470\charrsid15278858 she strayed and damaged a neighbour}{ \insrsid15402605\charrsid15278858 \rquote }{\insrsid13007470\charrsid15278858 s garden. The decea}{\insrsid15402605\charrsid15278858 sed was fined. He paid the fine.}{\insrsid13007470\charrsid15278858 The widow was }{\insrsid15402605\charrsid15278858 too }{\insrsid13007470\charrsid15278858 old. She could not}{\insrsid15402605\charrsid15278858 manage the cow. The same was sol}{\insrsid13007470\charrsid15278858 d to him and he transferred it to & friend. There was a letter of transfer Ex. D3.}{ \insrsid15402605\charrsid15278858 }{\insrsid13007470\charrsid15278858 Eventually the deceased invited him to join him in the homestead. He moved with his family to the deceased\rquote s land the land that was given to the defendant during the life}{ \insrsid15402605\charrsid15278858 time of the deceased Kaijaboho}{\insrsid13007470\charrsid15278858 re and that the cow was sold to the defendant and the house in the Kibanja was left to}{\insrsid15402605\charrsid15278858 the widow Kwebiiha. \par The learned co}{\insrsid13007470\charrsid15278858 unsel }{\insrsid15402605\charrsid15278858 appearing}{\insrsid13007470\charrsid15278858 for the plaintiff submitted that the case involved the law of Succession gift }{\insrsid15402605\charrsid15278858 intervivos}{\insrsid13007470\charrsid15278858 . }{\insrsid15402605\charrsid15278858 Joseph}{\insrsid13007470\charrsid15278858 Kaijabohore was a sick man and was some time mentally unstable and therefor}{\insrsid15402605\charrsid15278858 e a}{ \insrsid13007470\charrsid15278858 man of unsoun}{\insrsid15402605\charrsid15278858 d mind he could not give a}{\insrsid13007470\charrsid15278858 gift. The gift was void or voidable. That the defendant blackmailed the deceased in t}{ \insrsid12270626\charrsid15278858 he course of his difficulties. }{\insrsid13007470\charrsid15278858 Hospitality became an inducement with an axe to grind. }{\insrsid13007470\charrsid15278858 Ex}{\insrsid15278858 .}{\b\insrsid13007470\charrsid15278858 }{ \insrsid13007470\charrsid15278858 Dl contravened section 30 of the law of Evidence. The bataka had no mandate to speak for a man who was dead. They were meddling in}{\insrsid15278858 the estate of the deceased. Ex}{\insrsid12270626\charrsid15278858 .}{\insrsid13007470\charrsid15278858 D3 transfer }{\insrsid12270626\charrsid15278858 of cattle. That documen}{\insrsid13007470\charrsid15278858 t was not in the language }{\insrsid12270626\charrsid15278858 of}{\insrsid13007470\charrsid15278858 the court and the author was never called as a witness. }{\insrsid12270626\charrsid15278858 \par }{\insrsid13007470\charrsid15278858 Exhibit D4 was written on 11th March, 199}{\insrsid15278858 1 a}{\insrsid12270626\charrsid15278858 fter the death of Kaijabohore.}{\insrsid13007470\charrsid15278858 It}{\insrsid12270626\charrsid15278858 bears signature of several RC\rquote s}{\insrsid13007470\charrsid15278858 (Resistance council) Chairman. It was a useless document. It was in Lutoro language and was written long after the death of the deceased and the author was not called as a witness and the Bataka had no right to confer on the defendant estate of }{\insrsid15935795\charrsid15278858 the deceased. \par }{\insrsid13007470\charrsid15278858 Exhibit D5 conveyed the same meaning as exhibit Dl. The plaintiff being the lineal}{\insrsid15935795\charrsid15278858 descendant of Joseph Kaijaboho}{\insrsid13007470\charrsid15278858 re was entitled to administer the estate of her deceased father. The learned counsel referred me to a number of }{\insrsid15935795\charrsid15278858 authorities. \par }{\insrsid13007470\charrsid15278858 Mr. Mugamba the learned counsel appearing for the defendant submitted that the plaintiff who was the sole daughter of the deceased is not in a position to cater}{\insrsid15935795\charrsid15278858 for the widow. She was given a}{\insrsid13007470\charrsid15278858 piece of land in addition to one she already had. He continued he had seen frien}{\insrsid15935795\charrsid15278858 ds}{\insrsid13007470\charrsid15278858 sell off their properties to good booze and there is no need to consult the children. To say otherwise would mean no one owns }{\insrsid15935795\charrsid15278858 property}{\insrsid13007470\charrsid15278858 in his life. The deceased was firm mentally till his death. Even the plaintiff did not contradict this. It is not an act of insane person to call villagers and make a solemn declaration tending to alienation of ones }{\insrsid15935795\charrsid15278858 land}{\insrsid13007470\charrsid15278858 . Whereas a madman and drunken person would have just awarded land to the defendant and that would be the end but the deceased gathered very many }{\insrsid15935795\charrsid15278858 signatures}{ \insrsid13007470\charrsid15278858 on the document because people could not have taken him seriously. There was no indication of immediate death to the}{\insrsid15935795\charrsid15278858 }{\insrsid13007470\charrsid15278858 deceased. In the result the firs}{\insrsid3038848\charrsid15278858 t issue is in the affirmative. \par }{\insrsid13007470\charrsid15278858 On the second issue}{\insrsid3038848\charrsid15278858 ,}{\insrsid13007470\charrsid15278858 whether the defendant was the legitimate person to obtain letters of Administration to t}{\insrsid3038848\charrsid15278858 he estate of the late Kaijaboho}{\insrsid13007470\charrsid15278858 re. The defendant adduced in evidence documents to show }{\insrsid3038848\charrsid15278858 that the late Kaijaboho}{\insrsid13007470\charrsid15278858 re gave him his Kibanja during his life time because all the good things he did for }{\insrsid3038848\charrsid15278858 them the late Kaijaboho}{\insrsid13007470\charrsid15278858 re and the widow Kwebiiha. The }{\insrsid3038848\charrsid15278858 defendant}{ \insrsid13007470\charrsid15278858 (DWI) put in evidence exhibit Dl a document }{\ul\insrsid13007470\charrsid15278858 dated 23rd August 1988. }{\insrsid13007470\charrsid15278858 This was}{\insrsid3038848\charrsid15278858 an agreement between Kaijaboho}{ \insrsid13007470\charrsid15278858 re and Paulo Manyindo indicating that the former had given his land voluntarily to the latter and}{\insrsid3038848\charrsid15278858 the document clearly showed tha}{\insrsid13007470\charrsid15278858 t the land shared boundary with t}{\insrsid3038848\charrsid15278858 hat of the deceased\rquote s daughter t}{\insrsid13007470\charrsid15278858 he plaintiff. It was witnessed among very m}{\insrsid3038848\charrsid15278858 any others Chairman DW3 and DW4.
\par }{\insrsid13007470\charrsid15278858 The}{\insrsid3038848\charrsid15278858 re was yet another document Ex D}{\insrsid13007470\charrsid15278858 5 written on 22/8/89 }{\insrsid3038848\charrsid15278858 s}{\insrsid13007470\charrsid15278858 till confirming that the }{\insrsid3038848\charrsid15278858 deceased}{\insrsid13007470\charrsid15278858 }{\insrsid3038848\charrsid15278858 Kaijaboho}{\insrsid13007470\charrsid15278858 re gave his Kibanja as a }{\insrsid3038848\charrsid15278858 gif}{ \insrsid13007470\charrsid15278858 t during his life time}{\insrsid3038848\charrsid15278858 to the defendant. It was thumb }{\insrsid13007470\charrsid15278858 printed by both the deceased and Kwebi}{\insrsid3038848\charrsid15278858 iha the widow DW}{ \insrsid13007470\charrsid15278858 2. The writer of the document Byabasaija Andrea was never called as a witness but Kwebi}{\insrsid3038848\charrsid15278858 i}{\insrsid13007470\charrsid15278858 ha a}{\insrsid3038848\charrsid15278858 s DW2 came out }{ \insrsid13007470\charrsid15278858 stron}{\insrsid3038848\charrsid15278858 gly in support of both exhibit D}{\insrsid13007470\charrsid15278858 2 & Exh.}{\insrsid3038848\charrsid15278858 D5}{\i\insrsid13007470\charrsid15278858 .}{ \b\i\insrsid13007470\charrsid15278858 }{\b\i\insrsid3038848\charrsid15278858 \par }{\insrsid3038848\charrsid15278858 Exhibit D}{\insrsid13007470\charrsid15278858 3 was a letter from Vice Chairman Alex Kabare authorising the defendant to transfer away his cow which the said K}{\insrsid3038848\charrsid15278858 aijaboho}{ \insrsid13007470\charrsid15278858 re had sold to him. The Chairman the author of the letter was never called as a witness but there was evidence from DW2 whom I believed to}{\insrsid3038848\charrsid15278858 ld this court the truth that in}{ \insrsid13007470\charrsid15278858 fact the deceased had sold the cow in question to the defendant during his li}{\insrsid3038848\charrsid15278858 fe time \par Ex. D}{\insrsid13007470\charrsid15278858 2 was a docum}{\insrsid3038848\charrsid15278858 ent from the residents of Kitom}{\insrsid13007470\charrsid15278858 i (Nyakitovu Mirambi)}{\insrsid3038848\charrsid15278858 }{\insrsid13007470\charrsid15278858 con}{ \insrsid3038848\charrsid15278858 firming that the late Kaijabohore had given his}{\insrsid13007470\charrsid15278858 Kibanja (}{\insrsid3038848\charrsid15278858 land) to the defendant. The documen}{\insrsid13007470\charrsid15278858 t is dated 23/1/90 and wa}{\insrsid3038848\charrsid15278858 s}{\insrsid13007470\charrsid15278858 signed }{\insrsid3038848\charrsid15278858 by several residents of the are}{\insrsid13007470\charrsid15278858 a}{\insrsid3038848\charrsid15278858 .}{ \insrsid13007470\charrsid15278858 It was writte}{\insrsid3038848\charrsid15278858 n long after the said Kaijaboho}{\insrsid13007470\charrsid15278858 re had passed aw}{\insrsid3038848\charrsid15278858 ay and of course the residents could}{ \insrsid13007470\charrsid15278858 not confer title on the defendant and to crown it all they did not give evidence in court. Ex }{\insrsid3038848\charrsid15278858 D2 was of no evidential value. \par }{\insrsid13007470\charrsid15278858 The }{\insrsid3038848\charrsid15278858 crux}{\insrsid13007470\charrsid15278858 of the matter was whether the la}{\insrsid3038848\charrsid15278858 te Kaijaboho}{\insrsid13007470\charrsid15278858 re gave away his Kibanja (land) to the}{\insrsid3038848\charrsid15278858 defendant as a gift intervivos.}{\insrsid13007470\charrsid15278858 The learned counsel appearing for the plaintiff submitted that the deceased was a }{ \insrsid3038848\charrsid15278858 sick man}{\insrsid13007470\charrsid15278858 and was somehow mentally unstable and therefore as a man of unsound mind he could not give a valid gift. Th}{\insrsid3038848\charrsid15278858 e defendant b}{ \insrsid13007470\charrsid15278858 lackmailed the deceased in the course of his difficulties and that }{\insrsid3679915\charrsid15278858 the gift was void}{\insrsid13007470\charrsid15278858 and or voidable. \par Mr. Mugamba counsel for the defendant submitted that the sole daughter of the }{\insrsid3679915\charrsid15278858 deceased}{\insrsid13007470\charrsid15278858 was given piece of land in addition to the one she already had. She was not in a position to cater, for the deceased }{\insrsid13007470\charrsid15278858 and}{\i\insrsid13007470\charrsid15278858 }{\insrsid13007470\charrsid15278858 the widow and there was no need for the former to consult her since he had seen friends sell off their properties to good booze and there being no need to consult t}{\insrsid3679915\charrsid15278858 he children. \par }{\insrsid13007470\charrsid15278858 Turning to the issue, }{\b\ul\insrsid3679915\charrsid15278858 Halsbury\rquote s laws of England }{\b\ul\insrsid13007470\charrsid15278858 3}{\b\ul\super\insrsid13007470\charrsid15278858 rd}{ \b\ul\insrsid3679915\charrsid15278858 }{\b\ul\insrsid13007470\charrsid15278858 Editio}{\b\ul\insrsid3679915\charrsid15278858 n}{\b\ul\insrsid13007470\charrsid15278858 Vol. l8}{\b\ul\insrsid3679915\charrsid15278858 }{ \b\ul\insrsid13007470\charrsid15278858 Para 6}{\b\ul\insrsid3679915\charrsid15278858 9}{\b\ul\insrsid13007470\charrsid15278858 2}{\ul\insrsid13007470\charrsid15278858 }{\insrsid13007470\charrsid15278858 stat}{\insrsid3679915\charrsid15278858 es}{ \insrsid13007470\charrsid15278858 }{\insrsid3679915\charrsid15278858 g}{\insrsid13007470\charrsid15278858 ift intervivos i}{\insrsid3679915\charrsid15278858 s defined shortly. \par }{\i\insrsid3679915\charrsid15278858 \'93As}{\i\insrsid13007470\charrsid15278858 the transfer of any property fr}{\i\insrsid3679915\charrsid15278858 om one person to another gratuitously }{\i\insrsid13007470\charrsid15278858 while the donor is alive and not in}{\i\insrsid3679915\charrsid15278858 expectation}{\i\insrsid13007470\charrsid15278858 of death}{\i\insrsid15278858 . It is an act }{\i\insrsid13007470\charrsid15278858 whereby something is voluntarily transferred from the true }{\i\insrsid3679915\charrsid15278858 possessor}{\i\insrsid13007470\charrsid15278858 to another person with the full intention that the thing }{\i\insrsid3679915\charrsid15278858 shall }{ \i\insrsid13007470\charrsid15278858 not }{\i\insrsid3679915\charrsid15278858 be }{\i\insrsid13007470\charrsid15278858 return to the donor and with full intention on the part the receiver to retain the thing entirely as hi}{ \i\insrsid3679915\charrsid15278858 s}{\i\insrsid13007470\charrsid15278858 o}{\i\insrsid3679915\charrsid15278858 wn without restoring it to the giver.\'94 \par }{\insrsid3679915\charrsid15278858 Prima facie every one who}{\insrsid13007470\charrsid15278858 is sui juris can dispose by way of gift any property or any estate or interest therein to which he is absolutely entitled. That was when he wrote or c}{\insrsid4528899\charrsid15278858 aused to write exhibits Dl and D}{\insrsid13007470\charrsid15278858 5 and the same were never w}{\insrsid4528899\charrsid15278858 ritten in expectation of death. Ex D1 }{\insrsid13007470\charrsid15278858 was written on 23/8/88, whereas exhibi}{\insrsid13858835\charrsid15278858 t D}{\insrsid13007470\charrsid15278858 5 was written on 22/8/89 before the deceased passed away on 10/12/1989. D2 testified positively to this court that she witnessed the deceased hand over his land to the defendant and also testified positively that the cow which used to belong to the estate }{\insrsid13858835\charrsid15278858 was}{\insrsid13007470\charrsid15278858 sold to the }{\insrsid13858835\charrsid15278858 defendant. I watched this old lady aged about}{\insrsid13007470\charrsid15278858 90 yea}{\insrsid13858835\charrsid15278858 r}{\insrsid13007470\charrsid15278858 s she impressed me as a very truthful witness. The deceased }{ \insrsid13858835\charrsid15278858 voluntarily}{\insrsid13007470\charrsid15278858 gave away his Kibanja to the defendant a}{\insrsid13858835\charrsid15278858 n}{\insrsid13007470\charrsid15278858 d apparently the }{\insrsid13858835\charrsid15278858 couple} {\insrsid13007470\charrsid15278858 had, no love for the plaintiff. According to her never assisted them even during those difficult days when the deceased was bed ridden. }{\insrsid13858835\charrsid15278858 \par }{\insrsid13007470\charrsid15278858 The deceased indeed truly gave away his land voluntarily to the }{\insrsid13858835\charrsid15278858 defendant}{\insrsid15278858 }{\insrsid13007470\charrsid15278858 with full intention that the land shall not be returned to}{\insrsid13858835\charrsid15278858 him. E}{\insrsid13007470\charrsid15278858 x. D1 and Ex }{\insrsid13858835\charrsid15278858 D5}{\i\insrsid13007470\charrsid15278858 }{ \insrsid13858835\charrsid15278858 plus the testimonies of DW2, DW3 & DW4 confirmed }{\insrsid13007470\charrsid15278858 the deceased\rquote s intentions. I do not therefore a}{\insrsid13858835\charrsid15278858 gree with the submission of the}{ \insrsid13007470\charrsid15278858 learned counsel for the plainti}{\insrsid13858835\charrsid15278858 ff that the deceased was a man }{\insrsid13007470\charrsid15278858 of unsound mind when he wrote or caused th}{\insrsid13858835\charrsid15278858 e writing of Exhibit Dl and Ex}{\insrsid13007470\charrsid15278858 . D5, and that gave away his land when he expected death.
