The court found that the applicants had indeed filed their submissions as evidenced by the stamped copy annexed to their affidavit, and this fact was not disputed by the respondents. The omission by the court to consider these submissions constituted an error apparent on the face of the record. Applying the principles from National Bank of Kenya v Ndungu Njau and Order 45 Rule 1 of the Civil Procedure Rules, the court held that the applicants had satisfied the requirements for review. Consequently, the Notice of Motion dated October 23, 2020 was allowed, the previous ruling was reviewed, and a stay of execution was granted pending the hearing and determination of the applicants' appeal. Each party was ordered to bear its own costs.
