SUPREME COURT OF SEYCHELLES Reportable [2021] sese .6.=fS' eo 73/2020 In the matter between: THE REPUBLIC (rep. by Ms. Evelyn Almeida) and DINYO JASON ALCINDOR (rep. by Mr. Joel Camille) Accused Neutral Citation: The Republic v Alcindor (CO 73/2020) [2021] scse b7-5 Before: Heard: 19 October 2021 Dodin J 19 October 202 I Delivered: 19 October 2021 SENTENCE DODIN J [1] The convict stands convicted on his own guilty pleas to the following counts; count I Trafficking 12.71 g (purity) of heroin (diarnorphine). count 2 possesion 1.17 g of powder with presence of heroin, count 3 obstruction of an ANB Officer by resisting search (struggle). [2] I have heard Counsel in mitigation. The convict has pleaded guilty and saved Court's time and resources. He is a young person. lie was 18 years old then, he is now 19 years. The drugs is on the low side. He is gainfully employed as a Gardener. I find no aggravating factors other than he escaped and avoided being detained. [3] I impose the following sentences: Count I - 1 year imprisonment suspended for 2 years + a fine of Rs 20,000 to be paid within 6 months. Count 2 - Rs 1,000 fine. Count 3 - Obstruction - fine Rs 1,000 Total fines of Rs 22,000 to be paid within 6 months, in default 6 months imprisonment. He can pay by instalments.
