IN THE SUPREME COURT OF SEYCHELLES Criminal Side: CO 93/2015 [2016] SCSC 626 THE REPUBLIC versus TELMA D'UNIENVILLE Accused Heard: Counsel: Ms Faure, State Counsel for the Republic Mrs Amesbury for the accused Delivered: 1 September 2016 SENTENCE Dodin J [1] The Convict in this case is 51 years old. She is not in good health. She is a first offender has pleaded guilty and not wasted the Court’s time. [2] As learned counsel has stated in mitigation the amount of drug are very minimal weighing 2.3grams of heroin diamorphine 7.47grams of Cannabis resin and 0.7grams of Cannabis herbal material. [3] The Convict has pleaded guilty and not wasted the Court’s time. She is in employment earning a salary Rs7000 a month. Under the new drug regime all these offences would not carry a prison sentence. So I would impose the following fine on the Convict: Count 1 – Trafficking in 2.3grams of heroin diamorphine which is by presumption I impose a fine of Rs7000. Count 2 – Possession of 0.7grams of Cannabis herbal material I impose of Rs1000. Count 3 – Possession of 7.74grams of Cannabis resin a fine of Rs2000. [4] Cumulative Rs10,000 to be paid within 6 months of today. You can appeal against the sentences within 30 working days.
