SUPREME COURT OF SEYCHELLES Reportable [2021] SCSC 2,9 0 CR 46/2021 In the matter between THE REPUBLIC (rep. by Mr Ananth) and NEDDY LAGRENADE (rep. by Ms Domingue) 1ST Accused Neutral Citation: Before: Summary: Heard: Delivered: The Republic v Lagrenade (CR 46/2021) Govinden CJ Bail denied 5 July 2021 5 July 2021 ORDER [2021] SCSC 3q 0 Govinden, CJ 1. The Applicant Mr Neddy Lagrenade, has in his notice of motion dated the 1st July 2021 applied to be released on bail. In his affidavit in support of his application he sets forth the reasons for why he thinks that he should be released on bail at this juncture. These being his medical conditions which are that he is living on one kidney, he has a blocked ureter, he has uncontrolled diabetes, high blood pressure and has been tested positive for Covid-19 virus and that he is further liable to be exposed to re-infection. 2. As a result that he avers that being detained is not conducive and suitable for his medical conditions and that further that this places considerable stressed on his already frail health. He has attached a medical report to his bail application signed by a doctor of the Prison Services. 3. The Prosecution has strenuously objected to this motion in an objection to the bail application by the Respondent, filed in writing and the Prosecution avers that there is no compelling reasons for him to be released him on bail and no change of circumstances has been shown to exist. 4. The Republic in the alternative offers an alternative place for detention at the ANB Headquarters at New Port. 5. I have carefully scrutinized the said notice of motion for bail and its accompanied affidavit and the reply of the Prosecution thereto. 6. Having done so, I find that all the factors and issues raised in this application has been properly addressed by this Court in its ruling dated the 24th May 2021 on a similar application made by counsel for the 151 Accused. 7. I therefore find that it does not present this Court with any change of circumstances in the medical conditions of the accused person that will necessitate this Court to enlarge him on bail. Accordingly, the application is dismissed. He would therefore be remanded further until the 8th July 2021 at 2.00pm. It is up to the accused person to make use of the facilities offered by the Republic at the ANB Headquarters. The Court will leave this to his consideration.
