It is however, trite that in the exercise of its discretion the Court ought to exercise the same judiciously and not capriciously. It is also a settled principle of law that when considering an appropriate sentence to be imposed on a convict a Court of law should ensure that the same befits the crime as well as the convict whilst at the same time being fair to the society and be blended with some measure of mercy see, —The Republic y. Shautti, Confirmation Case number 175 of 1975 (unreported). It also trite that the maximum sentences permitted by the legislature should be reserved for the worst instance of the offence and that it is a very grievous example of the crime which calls for the imposition of such a sentence on a person of previous good character: see; Namate v Republic [1975- 1977] M. L. R. 132 at p. 135. This Court concurs with both the parties hereto that the offence of robbery with violence is a very serious offence as evidenced by the maximum sentence of death or imprisonment for life, vide: Section 301(2) of the Penal Code. From the cases of this nature perused by this Court it would seem that the sentencing trend for the offences of this nature is between 5 years to 10 years. This Court has given particular attention to the cases of Republic v Kasondo, Confirmation Case Number 447 of 2007 (unreported) cited by the State, where a sentence of 7 years was confirmed for the offence of robbery committed by a group of people and actual violence was used and R._v Twaibu Issa, HC/PR Confirmation Case Number 1056 of 2009 (unreported) cited by the Defence, where the convict and a friend hacked the complainant with a phanga knife and after struggling with the complainant stole a phone from him. A sentence of 9 years imposed by the lower court after it had considered mitigating factors that the convict was a first offender andyoung and the aggravating factors that actual injury had been inflicted on the complainant by the convict, a weapon was used in the commission of the offence and that more than one person was involved in the commission of the offence.
