1. I have perused the nolle prosequi dated 20. 6.2024 signed by Patrick Okango, Prosecution Counsel and I have considered the oral submissions of Counsels for the parties and I do hereby allow the discontinuation of the criminal prosecution of the 2nd accused person Emmanuel Ochieng Omondi who jumped bail on 14th February 2023 and all endeavours to trace him or his surety have been futile.

2. The warrants of arrest against Emmanuel Ochieng Omondi and his surety Zablon Omulo Okal of 0723xxxxxx shall remain in force.

3. This matter shall be mentioned on 25. 6.2024 for purposes of plea taking of the new information.
