1. This matter was partly heard by Musyoka J. This court became seized of the same on 9th March 2023.

2. On 22nd October 2024, the Prosecution closed its case after calling a total of four (4) Prosecution witnesses.

3. The Prosecution relied on the evidence on record in determination of the question of whether or not the Accused person had a case to answer. On his part, the Accused person filed Written Submissions dated 11th February 2025 on even date.

4. Having carefully considered the evidence by the Prosecution witnesses and the Accused person’s Written Submissions, the court was of the opinion that a prima facie case had been established against the Accused person herein to warrant him being put on his defence. He is hereby put on his defence.

5. It is so ordered.
