BENJAMIN KITILI MUSILI.....................ACCUSED

R U L I N G

1. Benjamin Kitili Musili is charged with the offence of Murder.  He seeks to be released on bail pending trial.

2. The application is premised on grounds that he is a primary school teacher with a fixed abode which he will not leave until the case is heard and determined.  The community where he hails from is not against his release and he is even ready to be reporting to the investigating officer if necessary.

3. He deponed an affidavit in support of the application.

4. In his response Mr. Mamba Vincent the prosecuting counsel did not oppose the application.

5. This being the case, it means that there is no compelling reason that would necessitate the accused person being denied bail.

6. In the premises, I grant him bond of Ksh 500,000/- with a surety in a similar sum.

7. It is so ordered.
