Between

Republic

Prosecution

and

Brian Okello Okoth alias Billy

Accused

Ruling

1. The accused is charged with the offence of murder contrary to section 203 as read with section 204 of the Penal Code.

2. When he was arraigned in Court on 8/5/2025, he pleaded not guilty and applied for bond. Ms. Kagali for the prosecution did not oppose the application.

3. I have considered the application ably argued by Mr. Maua learned counsel for the accused.

4. I have also considered the Pre-bail Report dated 20/6/2025. The same is negative of the accused. I have also considered the bail bond principles.

5. In the Pre-bail report, there is fear which has been expressed of possible interference with witnesses. That the accused had tried to do so before he was apprehended and charged.

6. For the foregoing reasons, it would not serve the interests of justice to release the accused to the community where the alleged witnesses live. In this regard, the accused will remain in custody for the time being until after at least 3 prosecution witnesses have testified when he can renew the application. It is so ordered.
