1. The accused person herein, B. O., has been convicted upon own plea of the offences of Cruelty to a Child c/s 151 (1) (a) and Child Neglect c/s 152 (1) (b); both of the Children Act No. 29 of 2022. She has admitted that on diverse dates between 18/03/2025 and 13/06/2025, at an area in Nakuru West sub-County within Nakuru County, being a person with parental responsibility for a child namely J. A., aged 8 years, she willfully and unlawfully subjected the said child to cruelty by inflicting physical harm through repeated acts of beating and assault, thereby causing physical and emotional injury to her.

2. She further denied in the second count that on the same dates and at the same area, being a person with parental responsibility over J.A., a female child aged 7 years, she willingly neglected the said child by failing to provide her with adequate shelter, food and protection thereby exposing her to potential physical and psychological harm and contributing to he becoming a child in need of care and protection.

3. She is a first-time offender as no previous records were furnished by the prosecutions. This is despite various reports presented herein indicating that she is a repeat offender. She has also pleaded for forgiveness. I have looked at the relevant provisions herein and I do hereby fine the accused person herein Kshs. 75,000/= in default to serve 18 months imprisonment in each count to run consecutively as required.14 days right of appeal explained.
