RULING ON SENTENCE
I have considered the mitigation of the accused as presented on the filed written submissions basically that:
i. That he is a single father of a son who needs parental responsibility.
ii. That he is remorseful and apologetic.
iii. That he is a first offender.
iv. That he is the sole bread winner of his young son.
v. That his family is ready to have him back
vi. That he prays for leniency and a non-custodial sentence.
vii. That he took the deceased to hospital and personally reported the matter to the police.
This court has also considered the probation officers report filed herein. This is a serious case of violence against a vulnerable child by a father under whose custody the child was. The accused ought to have exercised restraint in dealing with the minor. In my view, he deserves a custodial sentence.
Section 205 of the penal code provides:
“any person who commits the felony of manslaughter is liable to imprisonment for life.”
I have accordingly considered the mitigation of the accused, the circumstances of this case, the fact that the accused has been in custody from the time he was first arraigned in court on 18. 11. 2022 (Approximately 1 year and 2 months), and the sentence provided for as above shown. I sentence the accused to serve 15 years’ imprisonment. This sentence shall run from 18. 11. 2020, the date accused was first presented before the court. Right of appeal 14 days.
