IN THE SUPREME COURT OF SEYCHELLES THE REPUBLIC VS. NABI BUX (ACCUSED) OF THE FISHING VESSEL AL-FAAD Criminal Side No. 5 of 2010 Ms. Confait for the Republic Accused Present – Unrepresented ORDER Gaswaga, J Having listened to the Assistant State Counsel Ms. Confait and also considered the motion and affidavit of Andrew Souffe, an enforcement officer with the Seychelles Fishing Authority (SFA) together with the relevant provisions of the law, it is hereby ordered that: (i) The vessel, and communication equipment, fish and fishing gear seized by the authorized officers of the Seychelles Fishing Authority (SFA) on the 13 th of January, 2010 be delivered into the hands of the Court and further be dealt with in accordance with section 23 of the Fisheries Act, Cap 82. (ii) The fish referred to herein above in the impounded vessel shall be sold by the officers of the Seychelles Fishing Authority (SFA) and the proceeds thereof held and dealt with in accordance with the Fisheries Act. Mr. Nabi Bux Captain of the fishing vessel Al-Faad, being a foreign national, shall, pursuant to these proceedings be remanded until the 3 coming up for mention.    His place of remand shall be in the said vessel which is currently anchored in the waters of Port Victoria under arrestation. of February, 2010 at 9:00am the case will be rd I so order D.
