1. I have considered the Applicant’s notice of motion dated 9. 4.2024, the supporting affidavit sworn by Jael A. Onyango on even date and the annexures thereto. I have also considered the oral submissions of the party and I note that the application is unopposed and has even been conceded to by Ms. Odhiambo Counsel for the Respondent and I therefore allow the it and make the following orders:-1. An order of mandamus be and is hereby issued against the County Executive Member for Finance, County Government of Kisumu the Respondent herein to pay the Applicant the sum of Kshs.266,035 plus interest at the rate of 14% per annum from 17th December 2015 until payment in full, the said sum being the decree and certified costs in Kisumu High Court Miscellaneous Application No. 320 of 2015: Otieno Ragot & Co. Advocates -vs- The County Government of Kisumu.2. The Applicant is awarded costs of this application which are assessed at Kshs.60,000. 3.This file is marked as closed.
