VERSUS
DAVID MWANGANGI KILONZI .………….….….…......… ACCUSED
S E N T E N C E
I have considered the facts and circumstances of this case. I have also considered the mitigating factors.
The accused is a step son of the deceased. The deceased married the mother of the accused after his father died. The accused used a poisonous arrow to injure the deceased, resulting in death.
The accused is a first offender. He is remorseful. He is a young man aged 32 years and has been in custody since he was arrested, about 4 years ago.
He might have had issues with the deceased as his step father. However, I am of the view that using a poisoned arrow on someone is quite a serious undertaking, with serious consequences.
Considering all the facts and circumstances of the matter, I sentence the accused to serve eight (8) years imprisonment. He may appeal within fourteen (14) days.
Dated at Machakos this 10thday of December2012.
