RULING ON SENTENCE
The deceased was the accused’s son whom she gave birth to while in school. The child was aged 2 years and 3 months prior to his death.
It is the parents of the accused who were taking care of both the child and the accused.
She was convicted of manslaughter after a plea bargaining arrangement.
She has been in custody for about 9 months. She ought to have acted in a more responsible manner, as a mother.
I have considered the mitigation and the Probation Officer’s report.
She is sentenced to four (4) years which will be served as follows;
The first two years to be served in prison
The balance to be served on Probation under the supervision of the County Probation officer Kericho.
