Full Case Text

REPUBLIC OF KENYA

IN THE HIGH COURT OF KENYA AT MERU

CRIMINAL CASE NO. 53 OF 2013

REPUBLIC....................................................................................DPP

VERSUS

FRANCIS KINYUA ABDI ALIAS RASTA....................ACCUSED

SENTENCING

1. I have considered the mitigation on behalf of the accused. The 1st accused is a repeat offender while the 2nd accused is a first offender. They are both young men with a bright future. They are remorseful and have been in custody since 2013.

2. However, the Pre-sentence reports are very negative. The victim’s sentiments are considered. The accused attacked and patched the deceased in the most brutal vicious and barbaric manner. They are best separated from society. A death sentence is the one decreed by law. But for their mitigation, I sentence them to life imprisonment.

Right of Appeal 14 days explained.
