After hearing the evidence of the seven prosecution witnesses, I am satisfied that a prima facie case has been made out to warrant the accused being put on their defence.  Pursuant to section 306 (2) of the Criminal Procedure Code, Cap 75 of the Laws of Kenya, I hereby put the accused persons on their defence.  Their counsel shall indicate to court whether the accused shall give sworn or un-sworn evidence and whether they shall call any witnesses.
