REPUBLIC OF KENYA

IN THE HIGH  OF KENYA AT KERICHO

CRIMINAL CASE NO.28 OF 2014

REPUBLIC..................................................PROSECUTION

VERSUS

GEOFFREY KIPROTICH YEGON…....................ACCUSED

RULING ON SENTENCE

The accused was convicted of the offence of manslaughter after plea bargaining.

The person the accused killed was his step mother (I am the eldest wife of his father).

Land should not be used as as a reason for perpetrating criminal offences.

It is clear that besides the words uttered by the deceased, she did not attack nor injure the accused in any way.

I have considered the contents of the social inquiry report plus the fact that the accused has been out on bond since 31st December, 2014.  He was in custody for only four months.

He is sentenced to six (6) years imprisonment which will be served as follows:

The first three (3) years will be in prison.

The second set of three (3) years will be on probation.

Conditions are explained.

Delivered, Signed and Dated at Kericho this 9th day of  February, 2016.
