1. The Accused person's application for bail/bond was declined on 15th May 2024 by this court for reasons that the key witness who was the child of the Accused person had not testified and further that the Accused person is a flight risk.
2. The Probation Officer was asked to file another Prebail Report for review of the said Applicant.
3. The Prebail Report dated 16th December 2024 is favourable.
4. The key witness who is the minor child of the Accused person has already testified.
5. The Constitution of Kenya 2010 states that every accused person has a right to be granted bail unless there are compelling reasons not to grant bond.
6. I find that in the current case there are no compelling reasons not to grant the Accused person bail.
7. There is therefore good reason to review his bail application.
8. I grant the Accused person a bond of Kshs. 500,000/= with one surety of similar amount.
9. Directions have already been taken under Section 200 of the CPC to the effect that this case proceeds from where the previous court had reached.
10. Further hearing on 6th February 2025. Bond extended (if granted).
