JACK MURIUKI MUTEGI ..........................ACCUSED

SENTENCE

1. I have taken into account the uncontroverted fact that the accused surrendered self to the police, has been in prison all along and has saved a lot of judicial time by entering into a plea agreement.

2. I have also taken into account the age of the accused and the submissions that he was provoked by the deceased while he was drunk and that he has learnt his lessons while in custody.

3. I however appreciate that the act of taking another person’s life is a grave matter that leads to eternal loss to the family.

4. In the circumstances, I do consider that while lessons could have been learnt by the accused who is relatively young, a prison sentence of 10 years will serve the purpose of deterrence to the accused and other in society that violence leading to loss of life is not condoned by the justice system in this country.

5. I sentence the accused to serve jail term of 10 years to start running from today.

6. It is so ordered.
