Full Case Text

REPUBLIC OF KENYA

IN THE HIGH COURT OF KENYA AT MERU

HC CRIMINAL CASE NO. 89 OF 2017

REPUBLIC.............................................................................DPP

VERSUS

JAMES GITONGA NKUNJA...................................ACCUSED

RULING ON SENTENCE

1. I have considered the able mitigation made on behalf of the accused. That he is remorseful, and has young children. That he is now reformed and that the incident resulted from marital disagreements. I have also considered the fact that he pleaded guilty thereby saving courts time.

2. I have considered the victim impact Report/Pre-sentence on record which is extremely negative.

3. A life was lost at his hands and I therefore sentence him to 10 years imprisonment.
