Republic v Jeremiah Muthee [2017] KEHC 5717 (KLR)

Full Case Text

REPUBLIC OF KENYA

IN THE HIGH COURT OF KENYA AT MERU

CRIMINAL CASE NO. 42 OF 2012

REPUBLIC …………..……………………………….. PROSECUTOR

VERSUS

JEREMIAH MUTHEE  …………………….………………… ACCUSED

SENTENCE

I have considered the able mitigation made on behalf of the accused.  That he is a first offender, remorseful and that he has reformed as per the letter dated 16/5/2012 from the Prisons Department.

I have considered that the accused has been in custody for a long time and that he has a family that depends on him.

I have considered the Pre-sentence Report and the victim’s Impact Assessment Report filed on 15/5/2017.

Be that as it may, a life was lost at the accused’s hands.  The sentence is life imprisonment for the offence.

Taking into consideration of all the foregoing and the circumstances of the offence, I sentence the Accused to seven (7) years imprisonment.

SIGNED AND DELIVERED THIS 17TH DAY OF MAY, 2017.

A. MABEYA

JUDGE
