RULING
I have considered the bail application by Ms Waithaka for the accused in this case. The state was represented by Mr. Makori, learned State Counsel who had nothing much to say except to indicate that the State was not opposing the bail.
The accused is facing a charge of murder.
I see from the information that the incident took place in May this year. It is hardly two months since the incident.
I considered the Pre Bail Report by the Probation. Bail is recommended. I considered the witness statements in the complied Police file into this case. The evidence against the accused is overwhelming.
I find it too soon after the incident to grant the accused bail in this case. There is a domestic angle to the offence as wife of the accused was embroiled in the incident. I think that for purposes of peace and safety of all involved bail should not be considered at this time.
The accused may renew his application at a later date.
The application for bail is rejected for now.
