Republic v Julius Mari Ntongai & Lika Mwithalie Muroki [2017] KEHC 4787 (KLR)

Full Case Text

REPUBLIC OF KENYA

IN THE HIGH COURT OF KENYA

AT MERU

CRIMINAL CASE NO. 21 OF 2014

REPUBLIC..................................................PROSECUTOR

VERSUS

JULIUS MARI NTONGAI .............................1ST ACCUSED

LIKA MWITHALIE MUROKI .....................2ND ACCUSED

SENTENCING

I have considered the mitigation made on behalf of the 1st Accused.  I have considered the length of time he has been in custody, that he is a first offender and that he regrets the act.  I have considered that he pleaded guilty for a lesser charge thereby saving the Court time.

However, a life was lost as a result of his action. The maximum sentence is life.

Taking into consideration all the foregoing, I sentence the 1st Accused to eight (8) years imprisonment.

Mention on 18/10/2017 for 2nd Accused.

DATED, THIS 29TH DAY OF JUNE, 2017.

A. MABEYA

JUDGE
