1. Samuel Otwori Kegoya the accused herein stands charged for murder contrary to section 203 as read with section 204 of the penal code. He denied the charge and the case proceeded to full hearing with the prosecution calling ten (10) witnesses.

2. The cause of death was found to be asphyxia due to neck compression (PEXB1). The cause was therefore not a natural one. Upon consideration of all the evidence, I am satisfied that the prosecution had made out a prima facie case against the accused who I hereby place on his defence under section 306(2) of the Criminal Procedure Code.Orders accordingly.
