Ruling
1. The two accused persons Jackline Keitany and Hillary Kangogo have been charged with the offence of murder contrary to section 203 as read with section 204 of the Penal Code. The particulars of the charge are that on 18th day of February, 2025 at Aiyebo area, Tirimionin Sub-Location, Saimo Location Baringo North Sub-County within Baringo County jointly with others not before court murdered one Paul Zakayo.
2. The accused persons denied the charge and the defence counsel Mr. Chebii applied that they be released on bond. He submitted that the two accused persons are husband and wife. I called for pre-bail report which was filed on 14/5/2025. From the report, the Local Administration is not opposed to accused persons being released on bond. He indicated that they are well known to the community and are not flight risk. The victim’s family opposed bond saying that the accused persons should be granted bond after the other suspects who are not before court have been arrested.
3. However, the Investigating Officer has not filed any affidavit to indicate whether the 2 accused persons if released, are likely to interfere with their investigations. I also note from pre-bail report that the accused persons have 3 children who must be suffering in the absence of both parents. In view of the above, I find no compelling reason to warrant denying accused person’s bond.
4. Final Orders: -Each accused may be released on bond of Kshs. 500,000/= with one surety of a similar amount.
