RULING

The accused LEMERU MNYANGULU faces a charge of MURDER CONTRARY TO SECTION 203 as read with SECTION 204 OF THE PENAL CODE. The prosecution led by MR. ONSERIO, State Counsel called a total of eight (8) witnesses in support of their case. MR. GICHANA, Advocate represented the accused. I have duly considered the evidence adduced by the prosecution witnesses. I am satisfied that a prima facie case has been established to warrant the accused being called upon to give his defence in line with S. 306(2) of the Criminal Procedure Code.

It is so ordered.
