SENTENCING
I have considered the able mitigation made on behalf of the accused. I have considered that she is a first offender and that she is remorseful.
I have also considered the circumstances under which the offence occurred. I have noted that she is now a single mother of five young children her single act having dispatched her husband to his maker. I have taken note that she has been in remand for well over a year now and that she is aged only 35 years and has a long life ahead of her.
I have considered that the young children left behind might have no parent to look after them.
I have also considered the pre-sentence report on record which is positive of the accused.
I have also considered that a life was lost as a result of her action.
Taking all the foregoing into consideration, I sentence accused to three (3) years Community Service at Theera Health Centre under the supervision of the Probation Officer, Igembe District.
