Criminal Case 69 of 2015

PJO Otieno, J

October 31, 2023

Between

Republic

Prosecution

and

Philip Mubia

Accused

Sentence

1. Having listened to address by both counsel on mitigation and after perusal of the pre-sentence report, the court views the offence as very grave. The circumstances surrounding the incident and the extent of injuries do not justify the conduct of the accused. He thus deserves a custodial sentence to serve both retribution and deterrence.

2. He is sentenced to serve a period of twelve (12) years imprisonment computed from today (October 31, 2023). That period takes into account and discounts the period served in custody before he was admitted to bond.
