1. The accused was arraigned before this court charged with the offence of murder contrary to section 203 as read together with section 204 of the Penal Code (Cap 63) Laws of Kenya.

2. He pleaded not guilty to the charge and the prosecution case proceeded on. I have considered the evidence adduced by the prosecution at the close of its case and I am satisfied that, there is adequate evidence to place the accused on his defence. Therefore pursuant to the provisions of section 306 of the Criminal Procedure Code of Kenya, (Cap 75). I required the defence to indicate to the court how he will conduct his defence.

3. It is so ordered.
