1. I have considered testimonies of the prosecution witnesses in this case. The testimonies include two by the eye witnesses who were with the deceased that night.

2. . The fact that the deceased was murdered is clearly evident. It has also come out clearly that the deceased and the accused had been together earlier than evening. The motive is apparent.

3. I have also taken in consideration the exhibits produced. This include the report from the Government analysists. The blood samples found on the accused’s clothes were found to match the profile of the deceased, meaning that at some point the Accused came into contact with the Deceased.

4. I am satisfied that the state has established a prima facie case against the accused and I hereby put him on his defence.
