Sentence

1. I have considered the mitigation. That the accused is a first offender. That he is remorseful and would like to mend his relationship with the family and the Community.

2. I have considered that the offence occurred in a family set up, that it is the Accused’s own child who lost his dear life.

3. I have considered that the accused has owned up to his act and that the remaining children may not have someone to take care of them.

4. I have however noted the contents of the Pre-Sentence Report which is negative of the accused on the occurrence of the offence, his conduct and general attitude to his family.

5. His actions require deterrence. It is a sad situation. However, considering that he agreed to plea bargain and that saved the Court the time of the trial, I will sentence the accused top a lenient sentence of 15 years’ imprisonment.It is so ordered.
