RULING ON BOND

The accused Paul Kinoti Maore 20 years old is charged with the offence of Murder Contrary to Section 203 as read with section 204 of the penal code.

Particulars are that Paul Kinoti Maore on or between 27th and 28th day of April 2017 at Mutuati market Kabachi Location in Igembe North Sub-County within Meru County Murdered M’Amaiya Mwambia.

Plea was taken on 2nd August 2017 and Pre-bail Report called for.  The probation officers finding and recommendation is that accused is not suitable to be released on bond.

The reason being that according to accused persons uncle and deceased relatives accused is a reckless youth who while drunk takes pleasure in triggering fights with his pears besides committing other criminal offences with impunity.

That he has a nuisance in the community who has no respect to the rule of law;

That accused person’s uncle equally opposed issuance of bond saying he is a flight risk and that one can be a victim of revenge attack from deceased’s relatives.

In the circumstances this court finds that what are raised in social inquiry report are compelling reasons which cannot allow the accused to be released on bond.  Accused will remain in custody pending trial.
