RULING

The accused is charged with the murder of Loise Gesare Onganga.  In view of the provisions of the Constitution of Kenya 2010, the accused moved the court to be released on bond pending trial.

To assist the court in determining the issue of bond, the court called for pre-bail report which has now been presented and in which the same recommended that the accused be released on bond pending trial.

Since the state has not provided any compelling reasons to deny the accused his constitutional right to bond, I hereby order that the accused be released on bond on the following terms:-

Bond of Kshs.500,000/= with two sureties of similar amount.

In the alternative cash bail of Kshs.200,000/=.

During the period of his trial the accused to appear for mention before the D/R once after every 30 days at a date to be fixed by the said D/R.

The matter to be mentioned before the D/R on 28/1/2015 for purposes of fixing a hearing date.
