RULING

The two accuseds PETER WAWERU KINUTHIA (the 1st accused) and JOSEPH MWANGI MBUTHI (the 2nd  accused) are jointly charged with MURDER CONTRARY TO SECTION 203 as read with SECTION 204 OF THE PENAL CODE.

The prosecution called a total of five (5) witnesses in support of their case. I have considered the evidence on record. I am satisfied that a prima facie case has been proved. I therefore direct that both accuseds persons shall give their defence to this charge.
