1. The learned defence Counsel applied for reasonable bond for the Accused person who is facing a charge of murder contrary to Section 203 as read with Section 204 of the Penal Code Cap 63, Laws of Kenya.

2. The prosecution opposed the same relying on the Probation Officer’s pre-bail report filed in court dated 24th March 2025.

3. I have perused the said report and although it states that the Accused person has a wife and two children, he is considered a flight risk and there are possible repercussions if the Accused person is granted bond considering that the home environment is currently hostile and not yet ready for the release of the Accused person on bond.

4. I therefore find that although the Accused person has a right to be released on reasonable bond pending his trial and although every person is presumed innocent until proved guilty, there are compelling reasons in this case to warrant this court to defer the release of the accused person on bond until a later stage.

5. I accordingly decline to grant the Accused person bond at the moment until change of circumstances.

6. The Accused person can review his application at a later stage.
