R U L I N G  O N  S E N T E N C I N G

1. I have considered the able mitigation on behalf of the accused. He is a first offender a young man of 34 years and a single father of 6years old girl. She depends on him as the mother separated from him.

2. I have considered that he has been in custody for 4 years no and that he is remorseful.

3. I have considered the victim impact report dated 15/05/2020. The same is positive of the accused. I have also considered that the victim of the Accused’s offence was his father.

4. In the circumstances I sentence the accused to five (5) years imprisonment.

14 days right of appeal explained.
