1. Arnold Kiplangat Rotich referred to as the accused is charged with the offence of Murder contrary to section 204 of the Penal Code. The particulars being that the accused on 6th September, 2020 at Wakarimu Location, Rongai sub-location within Nakuru County murdered Winnie Jebiwott.

2. The accused denied the charge and the case proceeded to full hearing with the prosecution calling ten (10) witnesses. Both counsel filed written submissions with each stating their case.

3. Upon due consideration of the evidence by the witnesses and the submissions I find that the death and cause of death have been established. Without getting into what each witness stated, my finding is that the evidence by the witnesses (PW1, PW4, PW6, PW8 and PW9) has sufficiently established a prima facie case against the accused person.

4. I therefore place him on his defence under section 306(2) of the Criminal Procedure Code.

5. Orders accordingly.
