SENTENCING

I have considered the mitigation made on behalf o the accused.  I note than he is a first offender and has a family.

I have noted the circumstances in which the offence was committed, that the accused was provoked.

I have also considered the pre-sentence report of the accused dated 27/11/2017 which is positive.

In the circumstances, I sentence the accused to three (3) years probation under the Probation Officer, Isiolo.
