RULING ON SENTENCE
1. On sentencing, I have considered the able mitigation made on behalf of the accused.
2. I have considered that he is a father of 6 children who now have no parent to look after them. That he is a first offender and remorseful for his action.
3. I have considered that he has been in custody for 2 years.
4. I have in particular considered the causes of death of the deceased as disclosed in the post mortem produced as PExh 1.
5. I have considered the positive presentence report filed on 19/09/2018.
6. Taking into consideration all the foregoing, I sentence the accused to 6 months probation under the probation officer Igembe Sub-County.
