1. Having taken due consideration of the Probation Officer’s Report, the fact that the accused pleaded guilty to the charge at the first instance and the fact that she has been in custody for nineteen (19) months, that she is a widow in sole custody of three young children, it is the finding of the court that she deserves a lenient and non-custodial sentence to not only allow her rethink her ways and reintegrate into society but also be available for care and protection of her children.

2. On that basis, I do sentence and commit her to serve a probation term of three (3) years under the supervision of the Probation Officer in charge of Likuyani sub-county to be assigned by the County Director of Probation Kakamega county.
