Republic v Silas Kiinga Kiara, Henry Thiaine & Norman Baario Ikiao [2017] KEHC 4766 (KLR)

Full Case Text

REPUBLIC OF KENYA

IN THE HIGH COURT OF KENYA AT MERU

CRIMINAL CASE NO. 39 OF 2017

REPUBLIC...................................................PROSECUTOR

VERSUS

SILAS KIINGA KIARA.................................1ST ACCUSED

HENRY THIAINE..........................................2ND ACCUSED

NORMAN BAARIO IKIAO..........................3RD ACCUSED

RULING

I have considered the application for bail which is a Constitutional right for every accused person.

I have also considered the Affidavit of Samuel Igweta and CPL Thomas Mburi filed on 8/6/2017.

I have also considered the pre-bail reports dated 27/6/2017 on all the Accused.  The Affidavits and the pre-bail reports disclose the existence of compelling reasons why the bond sought should be denied.

The houses of the Accused are said to have been burnt by the Community out of fury.

Accordingly, bond is declined.  The Accused are to conduct their trial while in custody.

Mention on 18/10/2017 to give a date for trial.

DATED, THIS 29TH DAY OF JUNE, 2017.

A. MABEYA

JUDGE
