1. I have considered the current situation prevailing relating to the accused and note the following:1. The accused suffers from intellectual disability and her symptoms may never change.2. Her immediate family is unwilling to support her or take her in.3. She is incapable of standing trial.4. She is not only a risk to herself but the community.

2. I am inclined to commit the accused for treatment to the Nakuru County Referral and Teaching Hospital.

3. Owing to the fact that the DPP is determined to prosecute then this matter shall be periodically be mentioned before the DR to ascertain if the accused is fit to stand trial.It is so ordered.
